Currently, Indonesia’s vast airspace and the large number of airports and aircraft are regulated by a single law, Law No. 1 of 2009 on Aviation. Given the scale and strategic importance of Indonesia’s airspace, this book argues that a more comprehensive legal policy model should be developed under at least three separate laws: a law on aviation, a law on air transportation, and a specific law on airspace management. A dedicated Law on Airspace Management is necessary to address aspects that are not covered by the current aviation law.
In Chapter One, the authors present that Indonesia’s airspace is vast and strategic, making its use and management crucial for national defense, security, and the well-being of the Indonesian people.
Chapter Two discusses the regulation of Indonesian airspace specifically for national defense and security, including legal enforcement against airspace violations as outlined in Article 8 of Law No. 1 of 2009.
Chapter Three explores the need to regulate airspace over the Exclusive Economic Zone (EEZ), the continental shelf, and additional zones for the purpose of air defense identification.
In Chapter Four, the book highlights the national airspace as a territorial dimension and developmental asset, especially considering Indonesia’s strategic location at the crossroads of global air routes. Therefore, the optimal utilization and management of national airspace is crucial for national development.
Finally, Chapter Five concludes that while Indonesia’s expansive airspace offers many opportunities, it also presents significant challenges.
This book is highly recommended for academics, aviation professionals, and law students. It was written by experienced legal and aviation experts who have contributed to national policy discussions, including serving as resource persons at the Working Meeting and Draft Bill Committee on Airspace Management held by the Indonesian House of Representatives (DPR RI) on September 25, 2024.
